These Terms of Use govern your use of DexiFit, developed by Dexino Cloud & AI Solutions.

1. Acceptance of these Terms

By downloading, installing or using DexiFit, you agree to these Terms of Use.

If you do not agree with these Terms, you should not use the application.

2. Purpose of DexiFit

DexiFit is designed to provide a simple virtual workout counter for repetitive exercises.

Users may configure repetition counts, rest periods, sets and timing between repetitions.

DexiFit may provide spoken repetition numbers and countdown information using supported Android text-to-speech services.

3. User responsibility and exercise safety

Users remain responsible for selecting exercises, repetition levels, rest periods, resistance, intensity and workout duration appropriate to their own circumstances.

Users should exercise appropriate judgement, follow safe exercise practices and stop exercising if they experience concerning pain, dizziness, breathing difficulty or other symptoms requiring attention.

Where appropriate, users should seek advice from a qualified health, fitness or medical professional before beginning or changing an exercise programme.

4. No medical or professional advice

DexiFit does not diagnose medical conditions, evaluate physical fitness, prescribe exercise programmes or provide medical treatment.

The counting and timing functionality provided by DexiFit is not a substitute for professional medical, physiotherapy, rehabilitation, fitness or other specialist advice.

5. Android and device services

Certain DexiFit functions may rely on Android system services, including text-to-speech functionality.

Availability, voice quality, timing and behaviour may vary between devices, Android versions, installed speech engines and system settings.

6. Advertising

The free version of DexiFit may display advertisements using Google Mobile Ads / Google AdMob.

Under the current DexiFit advertising model, the first five completed workout sessions are intended to be free of full-screen interstitial advertising.

Starting with the sixth completed workout session, DexiFit may show one full-screen advertisement after a completed workout.

An advertisement may not appear on every eligible occasion because availability depends on network connectivity, advertising inventory, user consent, region, device configuration and the advertising provider's systems.

7. DexiFit Ad-Free

DexiFit may offer an optional one-time in-app purchase called DexiFit Ad-Free.

The intended benefit of DexiFit Ad-Free is permanent removal of advertisements from DexiFit for the applicable Google Play purchasing account, subject to successful purchase verification.

The intended Swiss launch price is CHF 1.99. The price shown by Google Play at the time of purchase is the applicable transaction price.

Prices may vary according to country, currency, taxes and Google Play pricing rules.

Unless expressly stated otherwise, DexiFit Ad-Free does not guarantee additional workout programmes, coaching, exclusive content or unrelated future premium functionality.

8. Google Play purchases

DexiFit Ad-Free purchases are processed through Google Play and are associated with the user's Google Play account according to Google's purchasing systems and policies.

Dexino does not directly process or store users' complete payment-card information.

Recognition or restoration of a previous Ad-Free purchase may depend on the Google account used for the original transaction and the availability of Google Play services.

Refunds and purchase disputes are handled according to Google Play policies, applicable consumer law and, where appropriate, Dexino's responsibilities as developer.

9. Privacy and consent

DexiFit may use Google advertising and consent-management services.

Users may be presented with privacy or consent choices depending on their location, applicable law and Google's requirements.

10. Third-party services

DexiFit may rely on third-party services including Google Play, Google Mobile Ads / AdMob, Google's User Messaging Platform, Android text-to-speech services and other Android or Google services.

Third-party services are governed by their own terms, availability, technical requirements and privacy practices.

Dexino is not responsible for interruptions, restrictions or changes independently caused by those third-party services.

11. Locally stored information

DexiFit may store workout-counter values, preferences, completed-workout counts and other application state locally on the user's device.

Locally stored information may be lost if application data is cleared, the application is uninstalled or the device is lost, reset, damaged or replaced.

12. Acceptable use

Users must not use DexiFit:

• for unlawful, fraudulent or intentionally abusive purposes;
• to attempt to compromise the security or integrity of DexiFit or its supporting services;
• to interfere unlawfully with advertising, purchase verification or application security mechanisms;
• to manipulate Google Play purchases or advertising systems fraudulently;
• to impersonate Dexino or falsely represent DexiFit as providing professional medical or clinical advice.

13. Application availability and changes

Dexino may update, modify, add, remove or discontinue DexiFit features where reasonably necessary for technical, legal, security, commercial or product-development reasons.

Dexino does not guarantee that every feature will remain permanently available or operate identically on every Android device or Android version.

14. Intellectual property

DexiFit's software, application interface, branding, original graphics, workout-counter design and related Dexino materials are owned by or licensed to Dexino Cloud & AI Solutions and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of DexiFit or Dexino intellectual property to users.

15. Disclaimer of warranties

To the extent permitted by applicable law, DexiFit is provided on an "as available" basis.

Dexino does not guarantee uninterrupted operation, availability of every advertising or platform service, compatibility with every device, perfect timing accuracy or completely error-free operation.

Nothing in these Terms excludes warranties, rights or remedies that cannot lawfully be excluded under applicable consumer-protection law.

16. Limitation of liability

To the extent permitted by applicable law, users remain responsible for their own exercise choices and physical activity.

Dexino is not responsible for indirect or consequential loss arising solely from the use or inability to use DexiFit or third-party services.

Nothing in these Terms limits liability where such limitation would be prohibited by applicable law.

17. Privacy

Information about DexiFit's handling of locally stored information, advertising, consent, third-party services and Google Play purchases is available in the DexiFit Privacy Policy.

18. Changes to these Terms

These Terms may be updated when DexiFit's functionality, advertising, purchase model, third-party services or legal requirements change.

The current version will be published on this page and identified by the "Last updated" date below.

19. Governing law

To the extent permitted by applicable law, these Terms are governed by the laws of Switzerland.

Mandatory consumer-protection rights applicable in a user's country or place of residence remain unaffected.

Where legally permitted, disputes relating to DexiFit or these Terms are subject to the competent courts at the registered place of business of Dexino Cloud & AI Solutions, unless mandatory law provides otherwise.
