These Terms of Use govern your use of DexiCam, a dashcam recording application developed by Dexino Cloud & AI Solutions.

Please drive safely: DexiCam is intended to assist with dashcam recording. Do not interact with your phone or the application in a way that distracts you while driving or violates applicable road-traffic laws.

1. Acceptance of these Terms

By downloading, installing, purchasing, subscribing to or using DexiCam, you agree to these Terms of Use.

If you do not agree with these Terms, you should not use the application.

2. Purpose of DexiCam

DexiCam is designed to allow a compatible Android phone to function as a dashcam.

Features may include live camera preview, 1080p video recording, background recording, blackout mode, autofocus, local recording storage and related functionality.

DexiCam is provided as a software tool and does not replace the driver's responsibility to operate a vehicle safely and lawfully.

3. Safe driving

The driver remains responsible for operating the vehicle safely and complying with all applicable traffic and road-safety laws.

Users should configure DexiCam before beginning a journey whenever possible and should not hold, adjust or interact with a phone while driving where doing so would be unsafe or unlawful.

A phone used with DexiCam should be mounted securely and positioned so that it does not obstruct the driver's view, interfere with vehicle controls or obstruct airbags or other safety equipment.

4. Recording laws and privacy

Laws relating to video recording, dashcams, surveillance, privacy, personal data, number plates and publication of footage vary by country, region and situation.

Users are responsible for determining whether recording is lawful in the locations where they use DexiCam and for obtaining any consent, permission or authorisation required by applicable law.

The availability of recording functionality in DexiCam does not constitute legal permission from Dexino to record any person, place, vehicle, conversation or activity.

5. Recorded content

Users remain responsible for recordings created with DexiCam, including their storage, use, sharing, publication and deletion.

Dexino does not claim ownership of recordings created by users with DexiCam.

Users must not knowingly use DexiCam recordings in a way that violates applicable law, privacy rights or the legal rights of third parties.

6. Local storage and backups

DexiCam is designed primarily as a local-first application. Recorded videos are normally stored on the user's device.

Dexino does not currently provide cloud backup or cloud storage for DexiCam recordings.

Users are responsible for maintaining backups of important recordings and ensuring that sufficient device storage is available.

Dexino cannot guarantee recovery of recordings if a device is lost, damaged, reset or replaced, if storage becomes corrupted, or if application data or video files are deleted.

7. Recording reliability

DexiCam is designed to provide practical dashcam recording functionality, but no software-based dashcam can guarantee that every journey, incident or event will always be recorded without interruption.

Recording may be affected by factors including device hardware, Android restrictions, storage availability, battery level, thermal conditions, camera availability, operating-system behaviour, background-process restrictions or unexpected application or device failure.

Users should verify that DexiCam is recording correctly before relying on it during a journey.

8. Evidence and legal use

Dexino does not guarantee that a DexiCam recording will be accepted, admissible or considered sufficient evidence by an insurer, court, law-enforcement authority or any other organisation.

Users remain responsible for preserving original recordings and providing them to third parties where appropriate.

9. Background recording

DexiCam may use Android foreground-service functionality to allow an active recording to continue while the application is not displayed in the foreground.

Android may display a persistent system notification while background recording is active.

The availability and reliability of background recording may depend on the device manufacturer, Android version, battery settings and other operating-system restrictions.

10. Blackout mode

DexiCam includes a blackout mode that allows the application display to become dark while an active recording continues.

Blackout mode is intended to reduce unnecessary screen illumination and distraction.

Blackout mode does not disable an active recording.

11. Annual subscription

DexiCam may offer an automatically renewing annual subscription through Google Play.

Eligible users may receive a three-day free trial before the annual subscription charge begins.

For users in Switzerland, the current annual subscription is offered at CHF 2.99 per year after an eligible free-trial period.

Prices, currencies and taxes may vary by country or region. The price displayed by Google Play at the time of purchase applies.

Unless cancelled, the annual subscription automatically renews according to the renewal terms displayed by Google Play.

Users can manage or cancel subscriptions through their Google Play account.

12. Lifetime purchase

DexiCam may also offer a one-time lifetime purchase providing continued access to the application features covered by that purchase.

For users in Switzerland, the current introductory lifetime purchase is offered at CHF 4.99.

Regional prices, currencies and taxes may differ according to the price displayed by Google Play.

A lifetime purchase refers to continued access to DexiCam under the terms of the one-time purchase for as long as the product remains available and technically supported.

A lifetime purchase does not guarantee that every existing feature will remain permanently unchanged or that DexiCam will remain compatible with every future device or Android version.

13. Google Play Billing

Subscriptions and one-time purchases are processed through Google Play and are associated with the user's Google Play account.

Dexino does not directly receive or store users' complete payment-card details.

Purchase restoration or recognition may depend on the Google account used for the original transaction and the availability of Google Play services.

Google Play's own terms, policies and billing rules may also apply to transactions made through Google Play.

14. Cancellation and refunds

Users may manage or cancel recurring subscriptions through their Google Play account.

Cancelling an annual subscription normally prevents future renewal but does not necessarily end access before the end of an already paid subscription period, subject to Google Play's applicable rules.

Refund requests, billing disputes and purchase issues are handled in accordance with Google Play policies, applicable consumer law and, where appropriate, Dexino's responsibilities as the application developer.

15. Application access and entitlement

DexiCam may use Google Play Billing information to determine whether a user has an active trial, annual subscription or recognised lifetime purchase.

Recording features may be unavailable where a valid paid entitlement cannot be verified.

Existing recordings stored on the user's device are not intended to become the property of Dexino merely because an application entitlement expires.

16. Third-party services

DexiCam may rely on or interact with Google Play, Android system services, device-manufacturer functionality and other third-party services required for application operation, distribution, billing or security.

Third-party services are governed by their own terms, policies, technical requirements and availability.

Dexino is not responsible for independent changes, restrictions or interruptions to third-party services.

17. Application availability and changes

Dexino may update, modify, add, remove or discontinue DexiCam features where reasonably necessary for technical, security, compatibility, legal, commercial or product-development reasons.

Dexino does not guarantee that DexiCam will operate identically on every Android device, manufacturer configuration or future version of Android.

DexiCam is provided as a software utility.

To the extent permitted by applicable law, Dexino does not guarantee uninterrupted operation, error-free recording, compatibility with every device, recovery of lost recordings or any particular legal, insurance or evidentiary outcome.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded under applicable consumer-protection law.

20. Limitation of liability

To the extent permitted by applicable law, Dexino is not responsible for indirect or consequential loss arising from device failure, storage failure, missed recordings, user misuse, unlawful recording, unsafe driving behaviour or circumstances outside Dexino's reasonable control.

Mandatory legal rights and liabilities remain unaffected where they cannot legally be excluded or limited.

Information about DexiCam's handling of information is available in the DexiCam Privacy Policy.

22. Changes to these Terms

These Terms may be updated when DexiCam's functionality, commercial model, third-party services or legal requirements change.

The date shown below will be updated when material changes are made. Users are encouraged to review this page periodically.
