These Terms of Use ("Terms") govern your download, installation, access to and use of Jumoke, an application provided by Dexino Cloud & AI Solutions.

By downloading, installing or using Jumoke, you agree to these Terms. If you do not agree with these Terms, you should not use the application.

2. Purpose of Jumoke

Jumoke is a visual wardrobe and outfit organisation application. It may allow users to photograph, import, organise, edit, compare and combine clothing, footwear, accessories and related images.

Jumoke may also provide access to shopping or other third-party websites and may display advertising.

Features may change, be added, restricted or removed over time.

3. Licence to use Jumoke

Subject to these Terms, Dexino grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use Jumoke for lawful personal purposes.

Except where applicable law expressly permits otherwise, you may not:

• copy, sell, rent, sublicense or commercially redistribute Jumoke;
• reverse engineer, decompile or attempt to derive Jumoke's source code;
• circumvent security, licensing, advertising or access controls;
• modify Jumoke for unauthorised redistribution;
• use Jumoke to violate applicable law or third-party rights; or
• interfere with the operation, security or integrity of Jumoke or related services.

4. Your photographs and other content

You retain ownership of photographs and other content that you lawfully create or own.

Dexino does not acquire ownership of your wardrobe photographs merely because they are used with Jumoke.

You are responsible for ensuring that content you photograph, import, save, edit, copy or use through Jumoke does not unlawfully infringe copyright, trademark, privacy, publicity or other rights belonging to another person or organisation.

You should not use Jumoke to copy, distribute or commercially exploit third-party content unless you have the necessary rights or another lawful basis to do so.

5. Device permissions

Certain Jumoke features require access to device functions such as the camera, photographs, media or storage.

You may refuse or revoke permissions through your device settings, but doing so may prevent the corresponding functionality from working correctly.

6. Local storage and responsibility for backups

Jumoke is primarily designed as a local-first application. Wardrobe photographs and related information may be stored on your device, including in Android media or gallery storage.

You are responsible for maintaining appropriate backups of any photographs or information that are important to you.

Dexino does not guarantee that locally stored content can always be recovered following deletion, device failure, operating-system changes, application updates, device replacement, corruption or other technical problems.

Uninstalling Jumoke may remove application-private data while images stored in shared device media locations may remain on the device.

7. Editing and image-processing features

Cropping, editing, capturing or other image-processing functions are provided as convenience tools.

Users should verify the resulting image before deleting or replacing an original file.

Dexino is not responsible for loss resulting from a user's accidental deletion, modification or replacement of content except where such liability cannot lawfully be excluded.

8. Shopping browser and third-party websites

Jumoke may allow you to access websites, online stores, products, services or content operated by third parties.

Dexino does not operate, control or guarantee those third-party websites or their products and services.

Unless expressly stated otherwise, Dexino is not the seller, merchant, manufacturer, payment provider, shipping provider or agent for products viewed through third-party websites.

Any purchase or transaction you make with a third party is between you and that third party and is subject to the third party's prices, terms, warranties, shipping conditions, return policies, privacy policy and other contractual conditions.

Dexino does not guarantee the accuracy of third-party product descriptions, prices, stock availability, sizing, quality, authenticity, delivery, refunds or representations.

Links or access to third-party content do not constitute an endorsement by Dexino.

9. Advertising

Jumoke may display advertisements supplied by third-party advertising providers, including Google Mobile Ads or Google AdMob.

Dexino does not guarantee or endorse products or services merely because an advertisement for them appears within Jumoke.

Your interaction with an advertiser, including any purchase, communication or transaction, is between you and the relevant advertiser or merchant.

10. Paid features and ad removal

Jumoke may in the future offer optional paid functionality, advertisement removal, subscriptions or other in-app purchases.

Where such functionality is offered through Google Play, purchases may also be subject to Google Play's applicable payment, refund and billing rules.

The price, duration and specific benefits of a paid feature will be displayed before purchase.

A purchase does not transfer ownership of the Jumoke software or Dexino intellectual property to the user.

11. Acceptable use

You agree not to use Jumoke:

• for unlawful, fraudulent or abusive activity;
• to violate another person's intellectual-property or privacy rights;
• to introduce malware, malicious code or harmful material;
• to interfere with Jumoke, its services or third-party services;
• to bypass technical restrictions or security mechanisms; or
• in any manner that could expose Dexino or another person to unlawful liability.

12. Intellectual property

Jumoke, including its software, application design, branding, graphics, interface, text, logos and other Dexino-created material, is owned by or licensed to Dexino and is protected by applicable intellectual-property laws.

"Jumoke", "Dexino" and associated branding may not be used in a way that falsely suggests sponsorship, endorsement or affiliation without permission.

Third-party trademarks, photographs, product names and other materials remain the property of their respective owners.

13. Updates and changes

Dexino may modify, update, improve, replace, suspend or discontinue features of Jumoke.

Updates may be required for security, compatibility, legal, commercial or technical reasons.

Dexino does not guarantee that every feature will remain available indefinitely or work on every device or future version of Android.

14. Availability

Dexino aims to maintain a functional and reliable application but does not guarantee continuous, uninterrupted or error-free availability.

Jumoke may be temporarily unavailable because of maintenance, third-party services, device limitations, operating-system changes, network failures, security issues or circumstances outside Dexino's reasonable control.

15. No warranty

To the maximum extent permitted by applicable law, Jumoke is provided on an "as is" and "as available" basis.

Dexino does not make warranties that Jumoke will always be uninterrupted, error-free, compatible with every device, free of all security vulnerabilities or capable of preserving every locally stored file.

Nothing in these Terms excludes warranties, guarantees or statutory rights that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by applicable law, Dexino will not be liable for indirect, incidental, special, consequential or purely economic loss arising from or relating to the use or inability to use Jumoke, including loss of data, loss of photographs, loss of profits, loss arising from third-party websites or purchases, or loss caused by circumstances outside Dexino's reasonable control.

Where Dexino is legally liable and applicable law permits a contractual limitation, Dexino's aggregate liability relating to Jumoke will not exceed the greater of:

• the amount you paid directly for Jumoke during the preceding twelve months; or
• CHF 50.

These limitations do not apply where liability cannot legally be excluded or limited, including liability arising from intentional misconduct, gross negligence or other liability that applicable law requires to remain unrestricted.

17. Responsibility for unlawful use

You are responsible for your own use of Jumoke and for complying with applicable law and third-party rights.

To the extent permitted by law, you may be responsible for losses or claims caused by your unlawful use of Jumoke or your unlawful use of third-party content.

18. Suspension or termination

Dexino may restrict or terminate access to Jumoke or particular services where reasonably necessary for security, legal compliance, fraud prevention, abuse prevention, protection of third-party rights, or discontinuation of a service.

You may stop using Jumoke at any time and may uninstall the application from your device.

19. Privacy

Use of Jumoke is also subject to the Jumoke Privacy Policy, which explains how information is handled.

20. General audience

Jumoke is intended for a general audience and is not specifically designed as a children's service.

Where a user is not legally able to agree to these Terms independently, use of Jumoke should take place only with the involvement or permission of a parent or legal guardian as required by applicable law.

21. Google Play

Where Jumoke is obtained through Google Play, use of Google Play, installation, billing, refunds and distribution may additionally be subject to applicable Google Play terms and policies.

Nothing in these Terms is intended to override rights or obligations that must apply under the rules of the applicable app-distribution platform or mandatory law.

22. Governing law and jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules.

Subject to any mandatory consumer-protection or jurisdiction rules that apply to you, disputes relating to these Terms or Jumoke shall be subject to the competent courts in the Canton of Zürich, Switzerland.

Nothing in this section deprives consumers of rights or legal forums that cannot validly be waived under applicable law.

23. Severability

If any provision of these Terms is found to be invalid, unenforceable or unlawful, the remaining provisions will remain in effect to the extent permitted by law.

24. No waiver

A failure by Dexino to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other right.

25. Changes to these Terms

Dexino may update these Terms where reasonably necessary to reflect changes to Jumoke, applicable law, security requirements, third-party services or business practices.

The current Terms will be published on this page together with the latest revision date.

Continued use of Jumoke after updated Terms become effective may constitute acceptance of those updated Terms where permitted by law. Where applicable law requires additional notice or consent, Dexino will follow those requirements.
